Probate refers to the legal process of administering the estate of a deceased person by giving notice to heirs, creditors and other claimants (such as taxing authorities) in order to distribute the estate to the heirs and/or devisees of the decedent. Probate is often necessary to establish marketable title to mineral interests for the purposes of distributing proceeds from the sale of oil or gas.
